Apparently ok...he went in the next race. Yes, it looked like the bike just broke beneath him.

Sulky banned at Meadows December 05, 2006
The Meadows announced early Tuesday morning that the AdvantEdge sulky will not be permitted to be used until further notice. The track’s action comes on the heels of driver Dave Palone’s sulky breaking before last Friday night’s sixth race.
In a press release issued by The Meadows, Palone described where the bike broke. "It split right on the arch, where the seat and the arch meet,” Palone said. “I talked with Tom Harmer (the creator of the sulky) and he said they did a stress test on the AdvantEdge sulkies, and they did have some fault,” Palone added. “He (Harmer) said they’re in the process of recalling all of the AdvantEdge brand sulkies and will fix the problem."
